By Wednesday, President Jos\u00e9 Antonio Kast was declaring that Chile had voted to \u00ableave stagnation behind\u00bb \u2014 and finance minister Jorge Quiroz was saying the quiet part plainly: Chile has approved \u00ablifting the permit barriers that were holding back investment, and giving certainty to those who risk making those investments.\u00bb It is, in everything but name, a Chile foreign investment law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Certainty<\/em> is the operative word \u2014 because the new Chile foreign investment law, read closely, is a machine for anchoring exactly that capital. And it enters a continent that is suddenly full of them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What passed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The megarreforma touches 36 laws and 15 decrees. Its pillars: the corporate tax rate falls gradually from 27% to 23% by 2029, ending what the government calls the double taxation of investment (small businesses keep their reduced regime). New housing goes VAT-free for twelve months. Repatriated capital gets fiscal benefits. The \u00abpermisolog\u00eda\u00bb \u2014 Chile&#8217;s notorious permitting labyrinth \u2014 gets surgery: shorter environmental-review timelines, sectoral permits that can only be invalidated within six months instead of two years, and, most strikingly, <strong>compensation for investors when courts annul environmental permits already granted<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then the crown: <strong>fiscal invariability for large projects<\/strong>. Investments above $50 million qualify for special investment rules, and for the biggest tickets \u2014 reported at $350 million and above \u2014 the law freezes key tax conditions for <strong>twenty years<\/strong>. Whatever future congresses legislate, the deal you signed is the deal you keep.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The clause with a foreign accent<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law never says the word \u00abforeign.\u00bb It doesn&#8217;t need to. Tax invariability is a foreign-investor technology by lineage: it is the direct descendant of Chile&#8217;s fabled DL 600 \u2014 the 1974 statute whose fiscal-stability contracts underwrote the construction of the entire foreign-owned copper industry, Escondida downward, before its retirement in 2016. Domestic capital rarely negotiates sovereignty risk with its own state; the investor who pays for a twenty-year freeze is the one who fears a future government more than a market cycle \u2014 and that investor, in Chile&#8217;s economy, sits in Melbourne, London, Phoenix or Toronto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Look at who was already at the door. BHP operates the world&#8217;s largest copper mine in Chile and is deepening its Andean position on both sides of the cordillera. Anglo American and Codelco are integrating neighbouring operations in a landmark joint plan. The lithium majors are recomposing the Atacama. Every one of them has spent a decade telling Santiago, through results calls and general counsels, that Chilean returns were world-class and Chilean <em>process<\/em> was not \u2014 permits measured in years, granted approvals reversed in court. The new law answers that complaint item by item, down to paying you back when a court takes your permit away. This is FDI legislation wearing a domestic suit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The certainty wars<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Here is the continental frame English-language coverage is missing. Chile&#8217;s move is not an isolated reform; it is the third front in what this Report has been tracking as <strong>Latin America&#8217;s certainty wars<\/strong> \u2014 the competition to promise foreign capital immunity from your own future politics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Argentina struck first: Milei&#8217;s RIGI offers thirty-year stability guarantees for projects above $200 million, and has attracted $44 billion in pledged projects \u2014 BHP and Lundin&#8217;s $9.7bn Vicu\u00f1a copper scheme among them \u2014 even as actual net FDI inflows remain startlingly thin. Mexico runs the counter-experiment: no certainty statute at all, a trade treaty surviving on annual reviews after Washington declined its renewal \u2014 and yet BlackRock, Apollo and KKR bidding on its infrastructure anyway, because proximity to the American market is its own guarantee. And now Chile, the continent&#8217;s traditional safe house, has decided that reputation alone no longer suffices \u2014 and legislated the strongest investor-anchoring toolkit of the three: shorter freezes than Argentina&#8217;s, but attached to a functioning state, an investment-grade rating and forty years of contract sanctity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prize all three are bidding for is the same: the copper, lithium and infrastructure capital of the anglosphere, at the exact moment the energy transition and the minerals race have made Latin America structurally necessary again.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The honest counterweight<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law is approved, not yet in force \u2014 and the tail carries risk. The government has announced partial vetoes of articles added during debate; the opposition is heading to the Constitutional Tribunal, which could delay enactment. Public opinion is against the centrepiece: 56% of Chileans oppose the corporate tax cut, per Cadem, and the left brands the twenty-year freeze a privilege for the largest investors and the permit-compensation clause a subsidy for litigation-proofing. The fiscal arithmetic is genuinely tight \u2014 the government itself inherited what its finance minister called an extraordinarily depleted treasury, and is now cutting rates while promising reconstruction spending. And the urgency is real for a reason that cuts both ways: Chile&#8217;s economy contracted 0.5% in the first quarter. The reform is a bet that certainty produces investment faster than tax cuts drain a thin exchequer. Bets can be lost.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The scoreboard<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Strip it to the essentials: the world&#8217;s most important copper country just offered the world&#8217;s investors twenty years of fiscal peace, six-month finality on permits, and its money back if the courts change their mind. Argentina promises thirty years from a wilder starting point; Mexico promises nothing and sells geography. Three different wagers, one shared conviction \u2014 that the next decade&#8217;s defining flow is foreign capital into Latin American ground, and that statutes, not speeches, are how you win it. The certainty wars are on.
